Billionaire Musk did not specify how far his plan has progressed. To form a new party in the United States, the party’s founding organization must qualify as a political party committee, and be registered with the Federal Election Commission.

According to Brett Kappel – a veteran election lawyer, Mr. Musk may still have a long way to go. Because each state of the United States has different legal rules for recognizing political parties. And the barriers for new parties are “not only high, but even extremely difficult to overcome”. As a result, building a national party in the U.S. could take years.

Tech billionaire Elon Musk’s statement came a day after he asked followers on social media X whether to form a new American political party. “You want a new political party and you will have it!” wrote the Tesla boss.

The announcement from billionaire Elon Musk came a day after President Donald Trump signed into law a new spending package that Mr. Musk vehemently opposed.

Earlier this week, Musk declared: “If the spending bill passes, the ‘America Party’ will be formed the very next day.”

Mr. Musk spent hundreds of millions of dollars to support President Trump’s campaign, and led the Department of Government Efficiency for a short time to cut spending and downsize the apparatus. But since then, he has disagreed with Trump over the spending bill.

Earlier this week, Trump threatened to cut billions of dollars in subsidies that Musk’s companies receive from the federal government.

Billionaire Elon Musk has previously said that he will form a new political party and spend money to retaliate against lawmakers who support the spending bill.

Republicans have expressed concern that the rift between Musk and President Trump could hurt their chances of defending their majority in the 2026 congressional midterm elections.
